Terms and Conditions for Metric Building Compliance - Daniel Reilly Ltd
CONDITIONS OF OFFER

By employing Daniel Reilly Ltd, you agree to the following terms and conditions.

Prices quoted are valid for thirty (30) days from the date of the quotation.

INVOICE AND REPORT ISSUANCE Once the site visit is complete, an invoice will be issued. Reports will only be forwarded upon receipt of full payment.

The quoted price is subject to adjustment if unforeseen circumstances or external constraints necessitate a price revision. Any additional samples required will incur charges at the agreed rate.

Daniel Reilly Ltd reserves the right to alter report formats or advertising literature without notice or liability.

Customers must provide all relevant information, including drawings, COSHH assessments, and other risk assessments, to assist Daniel Reilly Ltd in performing its duties on-site.

Sub-contractors for accredited work will only be employed with the customer's agreement and will be confirmed in writing.

Services provided by Daniel Reilly Ltd are exclusively for the customer’s benefit. No liability is accepted for third-party use of the services.

Daniel Reilly Ltd is not liable for any loss, damage, or additional costs caused by incomplete, incorrect, or delayed instructions provided by the customer.

The total liability of Daniel Reilly Ltd under this agreement will not exceed ten (10) times the charges for the services provided.

Daniel Reilly Ltd shall not be held liable for delays or failure to perform due to causes beyond its reasonable control.

Customers must indemnify Daniel Reilly Ltd against all costs, damages, or losses incurred due to claims arising from regulatory or legislative infringements by the customer.
CANCELLATION OR RESCHEDULING POLICY

Customers must provide at least 48 hours' notice for cancellations or rescheduling. Failure to do so may result in a cancellation fee equivalent to 20% of the quoted price.

Rescheduling is subject to availability and may incur additional charges if adjustments to survey schedules are required.
CONFIDENTIALITY AND DATA PROTECTION

All customer data and site information will be treated as confidential and handled in compliance with GDPR and relevant data protection laws.

Reports and survey data will not be shared with third parties without the customer’s explicit consent, except as required by law.
DISPUTE RESOLUTION

Any disputes arising from these terms shall be resolved through mediation or arbitration before pursuing legal action.

This agreement is governed by the laws of England and Wales.
FORCE MAJEURE CLAUSE

Daniel Reilly Ltd shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, or governmental actions.
INSURANCE COVERAGE

Daniel Reilly Ltd carries professional indemnity and public liability insurance. Documentation can be provided upon request.
CUSTOMER OBLIGATIONS

The customer must ensure a safe environment for surveyors and adhere to all site preparation requirements as specified by Daniel Reilly Ltd.

Failure to meet these obligations may result in delays, additional charges, or termination of services.
LIMITATION OF LIABILITY

Daniel Reilly Ltd shall not be liable for indirect or consequential damages, including loss of profit or reputation, arising from the performance of services.
RETENTION OF TITLE

All reports and deliverables remain the property of Daniel Reilly Ltd until payment is received in full.
AMENDMENTS
-
Daniel Reilly Ltd reserves the right to amend these terms and conditions with prior notice to customers.
WARRANTY OF SERVICES
-
Surveys and reports are based on findings at the time of inspection and do not guarantee future site conditions or asbestos presence.
HEALTH AND SAFETY 12. Daniel Reilly Ltd reserves the right to make necessary changes to services to comply with health and safety or statutory requirements. 13. Staff will not perform work outside existing health and safety policies or site requirements. 14. Customers must provide qualified personnel to isolate services where internal inspections are needed. This includes inspection of lift motor equipment, moving machinery, hot machinery, pipework, or other hazardous areas.
ACCESS REQUIREMENTS 15. Destructive inspections may be necessary for all survey types. Daniel Reilly Ltd accepts no responsibility for site damage unless otherwise agreed. The extent of damage will be determined on-site and limited to best safe practices. 16. The customer must provide required equipment or cover incurred costs for accessing areas beyond reasonable efforts or health and safety policy limits. 17. On-site risk assessments for occupied areas may impose limitations on survey procedures or final reports. 18. To access internal building areas, surveyors require contact persons with keys. All areas within the scope of work must be accessible. Inaccessible areas will be recorded and presumed to contain asbestos. 19. While efforts are made to identify concealed asbestos, not all asbestos materials may be located due to their use in composite structures and inaccessible places. Surveys will adhere to HSE Guidance HSG 264 and the Control of Asbestos Regulations 2012. 20. Daniel Reilly Ltd is not liable for omissions in reports due to the nature of asbestos materials. 21. Destructive inspections and accessible areas will be agreed upon with the customer before the survey begins. 22. Areas not accessed due to inadequate information or restrictions will be noted in the report and presumed to contain asbestos. Customers may choose to access these areas later based on work requirements and contractual obligations. 23. Customers must provide relevant plans prior to surveys to ensure all areas are inspected. If plans are unavailable, customers must supply a competent person to guide the surveyor. Reports will include rough sketches or schematics where plans are missing. 24. Customers must supply existing information regarding asbestos and other site risks before survey commencement to allow for risk assessment.
POTENTIAL ACCESS RESTRICTIONS

Access may be restricted to service ducts, risers, voids, or concealed spaces.

“Live” mechanical and electrical services may be presumed to contain asbestos.
-
Areas such as lift shafts, un-boarded loft spaces, or excessive heights will be presumed asbestos-containing unless made safe.
-
Furniture, fixtures, and fittings obstructing access will be noted in the report.
-
Access to voids, ducts, and similar areas will use existing removable access points unless damage is necessary and recorded.
-
Concealed or undiscovered areas will be presumed asbestos-containing.
